To mark our 20th Neighborhood Building Owners Alliance Advocacy Breakfast, we are departing from our usual practice of hosting an alderman and instead focusing our attention on the first election for a fully elected Chicago School Board and School Board President.

We will begin the meeting with a short legislative update from NBOA lobbyists, including the Mayor’s tenant ordinance and the alternative “Fair and Accountable Illinois Rental Ordinance (“FAIR“) that the City Council’s Common Sense Caucus introduced last week.

The ordinance would make sweeping changes to Chicago’s Landlord-Tenant Ordinance, adding more than 100 new regulations.

Major concerns include:

• Over one hundred new regulations: These regulations will increase costs for owners and tenants.

• “Just Cause Eviction”: Requires lease renewals unless a material violation is proven. “Just Cause Eviction? Perhaps better to call it an “Endless Lease?”

• New Fees: Imposes an annual fee of up to $60 per unit to fund a new enforcement department.

More than 1,300 people have signed our petition opposing the ordinance.

Housing providers and our lobbying team are meeting with aldermen to explain how this ordinance, if approved, would seriously harm housing providers and their tenants.

Our opposition centers on one key question: “How exactly would this ordinance make rents more affordable?”

Here is the latest:

• The PRO was officially introduced on June 29 during a subject matter hearing. No vote was taken during this meeting.

• The proposed legislation PRO was NOT on the Housing agenda during the Committee meeting that was held on July 8.

• There does NOT seem to be enough support at this time to advance the legislation out of the Housing Committee BUT that could change.

• NBOA Staff and lobbyists have spoken with nearly every member on the Housing Committee to schedule a meeting or discuss opposition to PRO.

• Meetings will continue to occur to ensure PRO does NOT advance.



• The conversations with members of the Housing Committee have focused on PRO’s negative impact on both housing affordability and communities. These messages are resonating so THANK YOU for all your help in signing the NBOA petition, talking with your Alderperson, or showing up to the Housing Committee meeting.

We call it “Mayor Johnson’s Housing Affordability Ordinance” — his name, and a reminder of the promise it’s supposed to keep.

Three core messages:

• A new fee funds a landlord registry — that raises costs, not rent.

• Just Cause forces us to renew leases for bad neighbors who disturb, harass, or commit crimes. It also lessens the chance that a housing provider will take a chance on a prospective tenant with blemishes on his or her credit or criminal background.

• 100+ new regulations favor corporate owners, pushing small owners to sell to them.

Results: A Tribune editorial board meeting produced a strong editorial before the ordinance was even introduced. We got great coverage in print and TV. Our line — “you can’t make housing more affordable by making it more expensive to provide housing” — even ran unattributed.

NBOA has created a web page containing a link to the full ordinance, an overview of media coverage that quoted NBOA members, and a campaign allowing you to send an email directly to the Alderman where you own properties or where you live.

A delegation of eight NBOA members is traveling to New York City today for a two-day, self-funded visit with our counterparts at the New York Apartment Association (NYAA) and the Small Property Owners of New York (SPONY).

Tonight, we’re starting the trip with our hosts by watching the Cubs take on the Mets at Citi Field, but tomorrow we’ll get straight to business. Our hosts will share their experiences with New York’s rent control laws and lead a tour of properties impacted by years of this legislation. Tomorrow evening, we will attend a meeting of the New York City Rent Guideline Board, where they will announce the permissible rent increases for the city’s one million rent-controlled units.

This trip is timely. Next week, Mayor Brandon Johnson is expected to introduce a radical restructuring of Chicago’s Landlord-Tenant Ordinance, which includes its own version of rent control. We are actively opposing this legislation alongside our industry partners, as we are deeply concerned about its harmful impact on housing supply, quality, and affordability.

In New York, we expect to see firsthand how radical housing policies lead to shrinking supply and skyrocketing rents for units not subject to control. We intend to bring these observations home via video, which we will share on our NBOA LinkedIn Page.

Regarding tonight’s game, rest assured we will not be putting ketchup on our Nathan’s hot dogs. Go Cubs!

As soon as next Monday, Mayor Brandon Johnson plans to introduce his “Protecting Renters Ordinance” (PRO), a massive overhaul of Chicago’s 40-year-old Residential Landlord and Tenant Ordinance (RLTO). 



We have seen preliminary versions of the ordinance, and it is a disaster for our industry and will make housing even less affordable.

The draft legislation we’ve seen includes several major changes to housing rules. They include:

• Rental registry: Establishes a citywide rental registry to allegedly track unit conditions, and ownership, including a requirement that we disclose the identities of all investors owning 20% or more of an LLC. The ordinance also will require housing providers to pay an annual fee to the City of up to $60 a unit. The proceeds of this fee will fund a “Bureau of Rental Housing Services,” which, among other things, will empower the City to penalize housing providers for violations of the RLTO.

• Bans fees: Prohibits so-called “junk fees,” such as supplemental application and processing fees, and mandates that any charged amounts reflect actual documented costs. The Illinois General Assembly recently passed legislation requiring a wide range of fee disclosures. The Mayor’s team should allow us a chance to learn to adapt to the soon to come new State law before burdening us with more confusing prohibitions regarding fee disclosure?

• Bans move-in fees and caps security deposits. The proposed ordinance incentivizes housing providers to start accepting security deposits by no longer requiring that we refund interest on security deposits, and offers “the right to cure” for certain violations of the security deposit provisions of the RLTO. A study conducted by one of our members reveals that at least half of our tenants prefer paying a smaller non refundable move in fee than a much larger refundable security deposit.

• Just Cause Eviction: The ordinance provides tenants with a perpetual right to renew their lease so long as they pay their rent on time and otherwise comply with the lease agreement. This untenable “endless lease” provision means that housing providers will no longer be able to “non-renew” a lease unless they can prove in court that a tenant has materially violated the terms of their lease. In short, housing providers will lose the ability to remove problem tenants without a costly and lengthy eviction process. 

• Backdoor rent control: If a tenant believes that a rent increase is “unconscionable,” they would have the right to reject it and demand relocation payments equal to four months’ rent or more. The proposed ordinance does not define what is “unconscionable.” Instead, a court would make that determination. 

The NBOA will be sharing our concerns about this proposed ordinance with the members of the City Council and explain to them why it will make housing less affordable and our buildings more difficult to manager.

1)  The City Council Committee on Housing and Real Estate is likely to conduct a hearing on the proposal at its next scheduled meeting on Monday, June 29, 10am, on the second floor of City Hall (121 N. LaSalle Street). Attend this hearing and support NBOA witnesses who we hope will have an opportunity to present statements in opposition. Look for an email later this week with more information.
